When a Pennsylvania worker dies from a work-related crash, weekly death benefits go to the worker's dependents. But who counts as a dependent — and for how long? Here is how Pennsylvania law sorts it out.

Surviving Spouse

A surviving spouse is generally presumed to be a dependent and is usually the primary recipient of death benefits. The spouse receives weekly payments based on a percentage of the worker's average weekly wage. Benefits to a spouse continue until the spouse's death or remarriage. If the spouse remarries, Pennsylvania law typically provides a final lump-sum payment equal to 104 weeks of benefits, and the ongoing weekly benefit then shifts to any eligible children.

Children

Minor children are presumed dependent. A child generally receives benefits until age 18 — or until age 23 if the child is enrolled full-time in an accredited college or educational program. A child who is physically or mentally incapable of self-support may continue to receive benefits beyond those ages. When there is both a spouse and children, the benefit percentage is higher than for a spouse alone.

Other Dependents

If there is no surviving spouse or children, other family members — such as parents or siblings — may qualify, but they usually must prove they were actually dependent on the worker for financial support. Unlike spouses and minor children, their dependency is not presumed and often becomes a point of dispute with the insurer.
